The Administrative Court in Linköping has today overturned the Swedish Gambling Authority's decision regarding a warning and penalty fee against Svenska Spel Sport & Casino AB. The court thus upholds the company's appeal.
– It is gratifying that the Administrative Court upholds our appeal and overturns the decision of the Swedish Gambling Authority. We appealed because we believe that the penalty fee is disproportionate in relation to the shortcomings and because there is a need to create greater clarity in the interpretation of the duty of care. We believe that the authority may only take measures that are supported by the legal order, the so-called principle of legality, which the court has also stated, says Fredrik Wastenson, CEO and Business Area Manager Svenska Spel Sport & Casino AB.
The background to the case is that in March 2024, the Swedish Gambling Authority issued a warning and a penalty fee of SEK 100 million to Svenska Spel Sport & Casino AB regarding a supervision of the duty of care in 2021. Svenska Spel subsequently appealed the decision and the Administrative Court in Linköping has now announced that the court is overturning the Swedish Gambling Authority's decision regarding the warning and penalty fee.
The judgment has not yet entered into legal force and may be appealed.
