On 25th January 2013 a second reading of the UK Offshore Gambling Bill is scheduled to take place. The bill, introduced by Conservative MP Matthew Hancock, attempts to bring offshore gambling operators under the UK fiscal and regulatory regime. Currently offshore operators are not governed by the same taxation laws as companies in the UK and this Private Member’s Bill looks to address this in an effort to regulate remote gambling at the point of consumption.
In March 2012 the Offshore Gambling Bill was published and aims to bring a new “point of consumption” approach to gambling licensing. A large number of the major bookmakers currently operate offshore thus avoiding figures reported to be about £300 million in tax per year.
The bill requires that anyone who markets their product to players in the UK will have to hold a Gambling Commission license irrespective of where their operations are based.
When the Offshore Gambling Bill was published Mr Hancock said:
“The largest bookmakers have been able to benefit from the offshore tax loophole for too long at the expense of a level playing field in the UK. This has caused immense damage to the public purse, independent bookmakers and the racing industry especially. The changes the Bill will being will ensure that this is no longer the case.”
Should the Bill be passed then we could see a more comparable rate of tax but issues concerning competition under European Law.
